1. Hizmet ve taraflar
Melano, [COMPANY LEGAL NAME] ([ADDRESS]) ("biz") tarafından sunulur. Melano, iş ekiplerinin güvenlik anketlerini ve benzeri belgeleri kendi bilgi kaynaklarından yanıtlamasına yardımcı olur: yüklenen belgeleri dizinler, bir yapay zekâ sağlayıcısı kullanarak kaynak gösterimli taslak yanıtlar hazırlar, insan incelemesini destekler ve tamamlanmış dosyaları dışa aktarır.
Hizmet, kuruluşların ve yetkili personelinin ticari kullanımı içindir; tüketicilere yönelik değildir.
2. Hesaplar ve kuruluşlar
Doğru hesap bilgisi vermeli ve parolanızı gizli tutmalısınız. Hesabınız üzerinden yapılan işlemlerden siz sorumlusunuz; yetkisiz erişimden şüphelenirseniz bize hemen bildirin.
Bir kuruluşun verilerine erişim rollerle (Owner, Admin, Member, Reviewer, Viewer) kontrol edilir. Kimin hangi rolle üye olacağına kuruluşun Owner'ları karar verir ve üyeliklerin güncel tutulmasından sorumludur.
Melano'yu yalnızca adına hareket etmeye yetkili olduğunuz bir kuruluş adına kullanabilirsiniz.
3. Müşteri içeriği
Kuruluşunuz, yüklediği veya oluşturduğu belgeler, anketler ve diğer içerikler ("Müşteri İçeriği") ile bunlar için üretilen yanıtlar üzerindeki tüm haklarını korur.
Bize, Müşteri İçeriğini yalnızca kuruluşunuza hizmeti sunmak, korumak ve desteklemek için gerektiği ölçüde barındırma, kopyalama, işleme ve iletme konusunda sınırlı ve münhasır olmayan bir hak tanırsınız; bu, Gizlilik Politikası'nda açıklandığı şekilde soru metninin ve seçilen belge pasajlarının yapay zekâ sağlayıcımıza gönderilmesini kapsar.
Bir kuruluşun Müşteri İçeriğini başka bir kuruluşun sorularını yanıtlamak için kullanmayız.
İçerdiği kişisel veriler dahil Müşteri İçeriğini yüklemek için gerekli haklara ve hukuki dayanağa sahip olmaktan ve bizimle paylaşmaya yetkili olmadığınız içeriği yüklememekten siz sorumlusunuz.
4. Yasak kullanım
Başka bir kuruluşun verilerine erişmeye, yetkilendirmeyi veya istek sınırlarını aşmaya ya da yazılı iznimiz olmadan hizmette güvenlik açığı aramaya çalışmak.
Zararlı yazılım veya yapay zekâ sağlayıcısını ya da diğer kullanıcıları manipüle etmeye yönelik içerik (örneğin başka kuruluşları hedefleyen prompt injection içerikleri) yüklemek.
Hizmeti mevzuata veya üçüncü kişilerin haklarına aykırı şekilde ya da işleme hakkınız olmayan verileri işlemek için kullanmak.
Onayımız olmadan hizmeti yeniden satmak, alt lisans vermek veya rakip bir hizmet geliştirmek için kullanmak.
Otomatik toplu istekler dahil hizmete makul olmayan yük bindirmek.
5. Yapay zekâ çıktıları ve insan incelemesi
Yanıtlar, sağladığınız içerikten otomatik olarak üretilir; kaynak ve güven puanı gösterildiğinde bile eksik, güncelliğini yitirmiş veya hatalı olabilir. Güven puanı bir göstergedir, garanti değildir. Hiçbir çıktının hukuki, teknik veya güvenlik açısından doğru ya da belirli bir amaca uygun olduğunu garanti etmeyiz.
Yanıtları kullanmadan veya üçüncü bir tarafa göndermeden önce incelemek kuruluşunuzun sorumluluğundadır. Bir yanıt ancak kuruluşunuzun bir üyesi onayladığında onaylı olarak işaretlenir; kuruluşunuz onayladığı ve gönderdiği yanıtlardan sorumludur.
6. Erişilebilirlik ve hizmetteki değişiklikler
Hizmeti erişilebilir tutmayı amaçlarız; ancak yazılı olarak bir hizmet seviyesi kararlaştırılmadıkça kesintisiz çalışmayı garanti etmeyiz. Özellikleri değiştirebilir veya kaldırabiliriz; işlevselliği önemli ölçüde azaltan değişiklikleri makul süre önceden bildiririz. [LEGAL REVIEW REQUIRED]
7. Ücretler
Hizmet, plana göre kullanım limitleri uygular. Şu anda hizmet üzerinden çevrim içi ödeme alınmamaktadır. Ücretler, kuruluşunuzla yapılan ayrı bir sipariş formu veya sözleşmede kararlaştırılır.
Bu koşulları ihlal eden veya hizmetin ya da diğer müşterilerin güvenliğini tehdit eden erişimi askıya alabiliriz; makul olduğu durumlarda önce sizi bilgilendiririz.
Kuruluşun Owner'ı kuruluşu istediği zaman kapatabilir. Kapatma, tüm üyelerin erişimini hemen sona erdirir ve kuruluşun içeriğinin, dosyalarının, denetim kaydının ve kullanım kayıtlarının kalıcı olarak silinmesini başlatır. Kapatma geri alınamaz.
Tek tek belgeler, anketler ve Yanıt Kütüphanesi kayıtları uygun role sahip kullanıcılar tarafından silinebilir. Müşteri İçeriği eskidiği için silinmez.
Üretilen dışa aktarım dosyaları mevcut teknik varsayılana göre oluşturulduktan 30 gün sonra otomatik silinir ve anket var olduğu sürece yeniden üretilebilir.
Kuruluşunuzu kapatmadan önce saklamak istediğiniz içeriği dışa aktarın.
9. Fikri mülkiyet
Hizmet, yazılımı ve dokümantasyonu bize aittir. Bu koşullar size aboneliğiniz süresince hizmeti kullanma hakkı verir; herhangi bir fikri mülkiyet hakkını devretmez. Bize ilettiğiniz geri bildirimler, herhangi bir yükümlülük doğmaksızın hizmeti geliştirmek için kullanılabilir.
10. Gizlilik
Müşteri İçeriğini gizli bilgi olarak kabul eder, yalnızca hizmeti sunmak için kullanır ve yalnızca bu amaçla ihtiyaç duyan ve gizlilik yükümlülüğü altındaki personel ile hizmet sağlayıcılara erişim veririz. Güvenlik önlemleri Gizlilik Politikası'nda açıklanmıştır.
11. Kişisel verilerin korunması
Kişisel verilerin nasıl işlendiği Gizlilik Politikası'nda ve KVKK Aydınlatma Metni'nde açıklanır. Müşteri İçeriğindeki kişisel verileri kuruluşunuz adına işlediğimiz durumlarda bir veri işleme sözleşmesi uygulanır; taslağına /dpa adresinden ulaşılabilir.
12. Garanti reddi
Hukukun izin verdiği ölçüde hizmet "olduğu gibi" ve "mevcut olduğu şekliyle", yazılı olarak açıkça kararlaştırılanlar dışında hiçbir garanti olmaksızın sunulur. [LEGAL REVIEW REQUIRED]
13. Sorumluluğun sınırlandırılması

1. The service and the parties
Melano is provided by [COMPANY LEGAL NAME], [ADDRESS] ("we"). Melano helps business teams answer security questionnaires and similar documents from their own knowledge base: it indexes uploaded documents, drafts answers with citations using an AI provider, supports human review and exports completed files.
The service is intended for business use by organizations and their authorized personnel, not for consumers.
2. Accounts and organizations
You must provide accurate account information and keep your password confidential. You are responsible for activity under your account; tell us promptly if you suspect unauthorized access.
Access to an organization's data is controlled by roles (Owner, Admin, Member, Reviewer, Viewer). The organization's Owners decide who is a member and with which role, and are responsible for keeping membership up to date.
You may only use Melano on behalf of an organization you are authorized to act for.
3. Customer content
Your organization keeps all rights in the documents, questionnaires and other content it uploads or creates ("Customer Content"), and in the answers produced for it.
You grant us a limited, non-exclusive right to host, copy, process and transmit Customer Content only as needed to provide, secure and support the service for your organization, including sending question text and selected document passages to our AI provider as described in the Privacy Policy.
We do not use one organization's Customer Content to answer another organization's questions.
You are responsible for having the rights and legal basis to upload Customer Content, including any personal data it contains, and for not uploading content you are not allowed to share with us.
4. Prohibited use
Attempting to access another organization's data, bypass authorization or rate limits, or probe the service for vulnerabilities without our written permission.
Uploading malware or content intended to manipulate the AI provider or other users (for example prompt-injection payloads aimed at other tenants).
Using the service in violation of law or third-party rights, or to process data you have no right to process.
Reselling or sublicensing the service, or using it to build a competing service, without our agreement.
Placing unreasonable load on the service, including automated mass requests.
5. AI-generated output and human review
Answers are generated automatically from the content you provide and may be incomplete, outdated or wrong, including when a citation and a confidence score are shown. A confidence score is an indication, not a guarantee. We do not warrant that any output is legally, technically or security-wise correct or suitable for a particular purpose.
Your organization is responsible for reviewing answers before using or sending them to a third party. An answer is only marked approved when a member of your organization approves it, and your organization is responsible for the answers it approves and submits.
6. Availability and changes to the service
We aim to keep the service available but do not guarantee uninterrupted operation unless a service level is agreed in writing. We may change or discontinue features; we will give reasonable notice of changes that materially reduce functionality. [LEGAL REVIEW REQUIRED]
7. Fees
The service applies usage limits per plan. Online payment is not currently processed through the service. Any fees are agreed separately in an order form or agreement with your organization.

8. Suspension, termination and data deletion
We may suspend access that breaches these terms or threatens the security of the service or other customers; where reasonable, we will tell you first.
An organization Owner can close the organization at any time. Closing it ends access for all members immediately and starts the permanent deletion of the organization's content, files, audit log and usage records. Closure cannot be undone.
Individual documents, questionnaires and Answer Library entries can be deleted by users with the right role. Customer Content is not deleted because of its age.
Generated export files are deleted automatically 30 days after creation under the current technical default and can be generated again while the questionnaire exists.
Export any content you want to keep before closing your organization.
9. Intellectual property
We own the service, its software and its documentation. These terms grant you a right to use the service during your subscription; they do not transfer any intellectual property. Feedback you give us may be used to improve the service without obligation.
10. Confidentiality
We treat Customer Content as confidential, use it only to provide the service, and give access to it only to personnel and service providers who need it for that purpose and are bound by confidentiality obligations. Security measures are described in the Privacy Policy.
11. Data protection
The Privacy Policy and the KVKK Notice describe how personal data is processed. Where we process personal data in Customer Content on your organization's behalf, a data processing agreement applies; a draft is available at /dpa.
12. Disclaimer
To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind beyond those expressly agreed in writing. [LEGAL REVIEW REQUIRED]
13. Limitation of liability
